In the matter of NILA LOGISTICS LLP

National Company Law Tribunal1 September 2026

Ratio decidendi

The rule this decision rests on

Where a Committee of Creditors resolves, by the requisite majority, to liquidate the corporate debtor after the CIRP has run its course without any resolution plan being received within the statutory period, and no extension has been sought or recommended, the Adjudicating Authority may order liquidation under Section 33(2) of the Code, the CoC's resolution being sufficient for that purpose. Delay in filing an application under Section 33 may be condoned where the Tribunal is satisfied, on the explanation offered, that the delay was occasioned by a change in the applicable regulations and the time needed to comply with it, and the Tribunal holds that explanation sufficient. The Adjudicating Authority may appoint as liquidator the insolvency professional proposed by the CoC who has given written consent in the prescribed form and whose registration and authorisation for assignment are shown to be valid.
