In the matter of Nextgen Infratel Private Limited

National Company Law Tribunal11 November 2025

Ratio decidendi

The rule this decision rests on

The Tribunal may permit withdrawal of an admitted corporate insolvency resolution process under Section 12A of the Insolvency and Bankruptcy Code, 2016, where the withdrawal is approved by the Committee of Creditors, the required voting threshold is met, and the costs of the process have been paid. Where the Committee of Creditors has approved withdrawal by a vote exceeding the threshold prescribed under Section 12A, the requirement of that threshold is satisfied, and the Tribunal may allow the application notwithstanding that the approving vote is greater than the minimum required.
