In the matter of Neueon Towers Ltd.

National Company Law Tribunal27 February 2024

Ratio decidendi

The rule this decision rests on

The applicant's challenge to the Resolution Professional's ineligibility determination under section 29A(a) was allowed on the reasoning that section 29A(a) disqualifies a person only where that person is an undischarged insolvent, and the mere pendency of a section 9 application against the applicant, without any adjudication of insolvency, does not by itself make the person an undischarged insolvent. The remaining applications (IA (IBC) 77/2024 and IA (IBC) 2026/2023) were adjourned or disposed of by directions to the parties and do not record any reasoning on a point of law.
