In the matter of Mountain Meadow Holidays Pvt. Ltd.
- CitationCompany Petition No. (IB)-499(ND)-2023
Ratio decidendi
The rule this decision rests on
The Tribunal held that a balance sheet signed by the corporate debtor's directors and recording the debt as outstanding amounts to an acknowledgment of debt within the meaning of the law of limitation, so that the period of limitation for the financial creditor's Section 7 application is extended from the date of the acknowledgment and the application is not barred. Where the corporate debtor, having been served with notice, neither appears nor files a reply, the Tribunal presumes that it has nothing to say in answer to the application. A corporate guarantee furnished by the corporate debtor to secure a loan extended to a principal borrower is a "financial debt" within the meaning of Section 5(8)(i) of the Insolvency and Bankruptcy Code, 2016, and the financial creditor is entitled to initiate corporate insolvency resolution process against the guarantor where it establishes default in repayment of that debt above the minimum threshold.
