Ratio decidendi

The rule this decision rests on

Where the Resolution Professional intimates the Adjudicating Authority, at any time during the CIRP but before confirmation of a resolution plan, of a decision of the Committee of Creditors approved by not less than sixty-six percent of the voting share to liquidate the Corporate Debtor, the Adjudicating Authority is bound under section 33(2) of the Code to pass an order for liquidation of the Corporate Debtor. Upon such an order, the Adjudicating Authority may appoint a liquidator under section 34(1) of the Code, the appointee being required to hold a valid Authorisation for Assignment issued by the Insolvency Professional Agency of which he is a member, in accordance with regulation 7A of the Insolvency and Bankruptcy Board of India (Insolvency Professionals) Regulations, 2016.
