In the matter of McNally Bharat Engg Co. Limited

National Company Law Tribunal9 November 2023

Ratio decidendi

The rule this decision rests on

The Tribunal, exercising its power on an application under Section 12(2) of the Insolvency and Bankruptcy Code, 2016, may extend the period of the corporate insolvency resolution process beyond the 270-day limit where the Resolution Professional shows that the delay arises from the ongoing resolution process, including a fresh challenge process conducted by the Committee of Creditors in its commercial wisdom in which resolution applicants actively participated, and that such extension is in the interest of justice.
