In the matter of MBE Coal & Mineral Technology India Pvt. Ltd.

National Company Law Tribunal12 September 2023

Ratio decidendi

The rule this decision rests on

The Tribunal holds that where the corporate debtor's own reply affidavit admits that it engaged the operational creditor to provide services and that it is unable to pay the operational creditor's debts, and where the record discloses no pre-existing dispute between the parties and an unpaid debt that the corporate debtor has defaulted in repaying, the application under section 9 of the Insolvency and Bankruptcy Code, 2016 is to be admitted. The Tribunal holds that the corporate debtor's financial difficulties, including disputes with its own customer and the default on its bank facilities, do not constitute a pre-existing dispute between the operational creditor and the corporate debtor, and that such matters do not preclude admission where the operational debt is established and unpaid.
