In the matter of Max Heighs Township and Projects Pvt. Ltd.

National Company Law Tribunal7 June 2023

Ratio decidendi

The rule this decision rests on

The Tribunal has jurisdiction to appoint an Authorised Representative for a class of creditors under section 21(6A)(b) of the Insolvency and Bankruptcy Code, 2016 read with Regulations 4A and 6A of the CIRP Regulations, on the application of the Resolution Professional, where the proposed representative has filed written consent in Form AB as required by Regulation 4A(3) and holds a valid Authorisation for Assignment issued by an Insolvency Professional Agency. Where the allottees of a real estate project, as a class of creditors, have by majority voting share (here 91.13% of the verified allottee claims) agreed upon a particular insolvency professional to act as their Authorised Representative, the Tribunal may appoint that professional to represent the class in the Committee of Creditors, the majority of the class having thereby exercised their choice under the Regulations.
