Ratio decidendi
The rule this decision rests on
The Tribunal holds that the costs of the Corporate Insolvency Resolution Process, including the Resolution Professional's fee and out-of-pocket expenses, are to be borne by the members of the Committee of Creditors in proportion to their voting shares, where those members do not dispute their responsibility to contribute and dispute only the quantum claimed. The Tribunal holds that where the Resolution Professional has rendered services in the process and the quantum of the claimed fee and expenses is shown to be reasonable on the record, the amount so established is to be apportioned among the Committee of Creditors members in accordance with their respective voting shares.
