In the matter of M P Sakthivel,

National Company Law Tribunal23 February 2024

Ratio decidendi

The rule this decision rests on

The Tribunal's decision on the application rests on the following reasoning. Section 94(1) of the Code permits a personal guarantor to apply for the initiation of the insolvency resolution process by himself, so that a personal guarantor's self-initiated application is a competent application under that provision. Where a personal guarantor has himself moved the application under Section 94, the Adjudicating Authority may, on being satisfied as to the proposed professional's eligibility and the absence of any disciplinary action against him, appoint the proposed insolvency professional as Resolution Professional for the personal guarantor, and direct that Resolution Professional to examine the application under Section 97(6) and recommend acceptance or rejection within the period prescribed by Section 99(1).
