National Company Law Tribunal10 November 2023

Ratio decidendi

The rule this decision rests on

The Tribunal disposed of the application by directing the liquidator to communicate a decision on the claim within four weeks, and did not determine the delay condonation or the admissibility of the claim. The text contains no reasoned holding on any legal principle; the only operative reasoning is that Section 42 of the Code provides for an appeal within 14 days of receipt of a liquidator's decision, and that no such decision had been communicated, which is a finding on the facts of this case rather than a rule of law on which the disposal rests. NO_RATIO: the order disposes of the application by a procedural direction to the liquidator to communicate a decision, without deciding the condonation of delay or the admissibility of the claim, and its only reasoning is a factual observation that no decision had been communicated.
