National Company Law Tribunal16 December 2024

Ratio decidendi

The rule this decision rests on

The Tribunal's reasoning rests on a single principle, applied to the facts: where the Committee of Creditors, by a 100% vote, has approved the liquidation of the corporate debtor under Section 33(2) of the Insolvency and Bankruptcy Code, 2016, after no resolution plan was received from any prospective resolution applicant, the Adjudicating Authority may allow the Resolution Professional's application and order liquidation, subject to the approval of the CoC and the requirements of the Code and the Liquidation Process Regulations being satisfied.
