In the matter of JSM Oilfield Services Private Limited

National Company Law Tribunal3 June 2024

Ratio decidendi

The rule this decision rests on

The order rests on a procedural ground: that a winding-up petition under Sections 433(e) and 433(f) of the Companies Act, 1956, which has been transferred to the Tribunal under Section 433(1) of the Companies Act, 2013, falls to be dealt with as an application for initiation of corporate insolvency resolution process under the Insolvency and Bankruptcy Code, 2016, and that the Tribunal may call upon the regulator to prescribe, through the CIRP Regulations, the appropriate form of application (Form 1, Form 5 or Form 6) to be filed in such cases according to the category of applicant.
