Ratio decidendi
The rule this decision rests on
The Adjudicating Authority, on a section 7 petition, is required to ascertain the existence of a default from the records of an information utility or other evidence furnished by the financial creditor, and it is satisfied on that footing where a financial debt is shown to exist, the amount claimed exceeds the threshold of Rs. 1 crore, the default is evidenced by the NeSL certificate, and the claim falls within the limitation period calculated from the execution of the loan documents and the date of default; the corporate debtor's failure to appear or contest the petition does not prevent this inquiry, and the application may be admitted where no legal impediment to initiating the process is found on the material on record.
