In the matter of IDBI Bank Ltd. vs. Prince Goyal,

National Company Law Tribunal12 August 2021

Ratio decidendi

The rule this decision rests on

The Tribunal on an application under Section 95 of the Insolvency and Bankruptcy Code, 2016 does not decline to act on a petition by reason only that the corporate debtor's insolvency has already progressed to liquidation; it proceeds to appoint a resolution professional to examine the application under Section 99(1) and to direct an advance payment of fees by the financial creditor. The interim moratorium under Section 96(1)(a) commences on the date of filing of the application by the financial creditor, operates until the date of admission, and during its currency stays any pending legal action or proceeding in respect of a debt and bars creditors from initiating fresh legal action or proceedings in respect of any debt.
