In the matter of HERO ELECTRIC VEHICLES PRIVATE LIMITED

National Company Law Tribunal2 April 2026

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority may approve the replacement of a liquidator under the Insolvency and Bankruptcy Code, 2016 where the Stakeholders' Consultation Committee has, by a resolution passed with the requisite voting share, recommended the replacement, subject to the Adjudicating Authority's approval, and the application is filed on the basis of that resolution; the Tribunal's approval of the substitution rests on the SCC resolution and the voting record shown in it.
