The rule this decision rests on
The Adjudicating Authority may approve the replacement of an Interim Resolution Professional by a Resolution Professional proposed by the Committee of Creditors under Section 22(3)(b) of the Insolvency and Bankruptcy Code, 2016, where the Committee has resolved to make the replacement, and the approval is given on the basis of that resolution. Where the Committee of Creditors has resolved to replace the Interim Resolution Professional with a new Resolution Professional, the Resolution Professional so appointed is directed to comply with the provisions of the Code and to perform the duties assigned to him under it, in particular those under Section 25(1) concerning the protection of the assets of the corporate debtor. Where applications under Section 60(5) remain pending and the Interim Resolution Professional has failed to file a reply as directed, a change in the professional holding office following the Committee's resolution is treated as a changed circumstance, and the newly appointed Resolution Professional is directed to file the reply within a fixed period, with any rejoinder to follow within a further fixed period.
