In the matter of Girdharilal Sugar and Allied Industries Limited IA 96 of 2022 In TP 182 of 2019
- CitationCP(IB) 591 of 2019
Ratio decidendi
The rule this decision rests on
The Tribunal, having been moved under Sections 33(1), 33(2) and 34(1) of the Insolvency and Bankruptcy Code, 2016, and having found that the Committee of Creditors resolved in its eleventh meeting to recommend liquidation after two resolution plans were rejected and the extended corporate insolvency resolution period had expired, held that where the Committee of Creditors so resolves and the statutory period has run out without an approved resolution plan, the Adjudicating Authority is to pass a liquidation order, and it accordingly ordered the liquidation of the corporate debtor and allowed the application. The Tribunal further held that, upon the commencement of liquidation, the moratorium under Section 14 ceases to have effect from the date of the liquidation order, and that all powers of the board of directors, key managerial persons and partners of the corporate debtor vest in the liquidator from that date.
