In the matter of GILCO STEELS LIMITED
- CitationCompany Petition 271/Chd/Chd/2024
Ratio decidendi
The rule this decision rests on
The Tribunal holds that a financial creditor's Section 7 application may be admitted where the claimed debt exceeds the Section 4 threshold of Rs. 1 crore and the statement of account, the default, and the corporate debtor's own acknowledgment of the liability (an offer of settlement acknowledging the debt) together establish that the financial debt is due and payable and default has occurred, so that the requirement of Section 7(5)(a) is satisfied. Where the application is not accompanied by a valid affidavit in the prescribed form (AFA), the Tribunal may, rather than rejecting the application on that ground, direct the proposed interim resolution professional to place a fresh AFA on record before his appointment is given effect.
