National Company Law Tribunal3 August 2023

Ratio decidendi

The rule this decision rests on

Under Section 7 of the Insolvency and Bankruptcy Code, 2016, a financial creditor's petition is not barred by limitation where a judgment, decree or Certificate of Recovery in its favour has been passed by a Debt Recovery Tribunal or other court, the Financial Creditor may initiate Corporate Insolvency Resolution Process within three years from the date of that judgment or decree, or from the date of issuance of the Certificate of Recovery, if the dues remain unpaid. Under Section 7(2) to (5) of the Code read with the Adjudicating Authority Rules, 2016, there is no bar on filing documents at any time until a final order admitting or dismissing the application has been passed; accordingly, an application to bring on record a subsequent order establishing a corrected date of default may be allowed. Where the financial creditor's records and the corporate debtor's balance sheet acknowledge the secured loan within three years of the date of default as corrected, the petition is within limitation, and the existence of a debt exceeding the threshold in Section 4 that the corporate debtor has defaulted in repaying is established, so that the application under Section 7 is complete and may be admitted.
