National Company Law Tribunal30 April 2024

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority, having been directed by the appellate tribunal to decide afresh an application under Section 10 of the Insolvency and Bankruptcy Code, 2016, may admit a corporate applicant's voluntary insolvency application where the debt and default are established from the corporate debtor's financial statements and no creditor has objected to the debt or default following the public notices published in the newspaper. Upon admission of a Section 10 application, the moratorium under Section 14(1) of the Code follows as to the corporate applicant, and the Interim Resolution Professional is to be appointed and the consequential steps under the Code (public announcement, management vesting under Section 17, and the directions set out in the order) taken forthwith.
