National Company Law Tribunal22 November 2023

Ratio decidendi

The rule this decision rests on

The Tribunal may order liquidation of a corporate debtor under Section 33 of the Insolvency and Bankruptcy Code, 2016 where, after the Committee of Creditors has resolved for liquidation and no resolution plan has been received despite repeated invitations, including after a second expression of interest and a 90-day extension of the CIRP, and there is no alternative to liquidation in the totality of the circumstances. Where the Committee of Creditors, in a subsequent resolution, requests that the Tribunal appoint a liquidator from its panel under Section 34 of the Code and no other insolvency professional has consented to act, the Tribunal may appoint a liquidator from its panel in accordance with that resolution.
