In the matter of Champion Agro Limited

National Company Law Tribunal25 January 2024

Ratio decidendi

The rule this decision rests on

Where the Committee of Creditors, in the exercise of its commercial wisdom, has resolved to liquidate the corporate debtor and has not approved any resolution plan, the Adjudicating Authority will not interfere with that decision and will order liquidation under section 33(2) of the Insolvency and Bankruptcy Code, 2016, where the application is made by the Resolution Professional under section 33(1)(b). Upon an order of liquidation under section 33(2), the moratorium under section 14 ceases to have effect from the date of the order, and the Adjudicating Authority may, under section 34(4)(b), appoint an insolvency professional other than the Resolution Professional as liquidator, in accordance with the Insolvency and Bankruptcy Board's circular recommending such appointment.
