In the matter of Castex Technologies Limited

National Company Law Tribunal17 January 2024

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority, in an application under Section 60(5) of the Insolvency and Bankruptcy Code, 2016, will direct the issuance of a sale certificate and registration of the sale deed in favour of an auction purchaser where the purchaser has deposited earnest money, has undertaken in writing to deposit the balance sale consideration within a fixed period, and the Asset Monitoring Committee raises no objection to the sale, the corporate debtor's pending settlement discussions over other properties not being a ground to withhold the sale certificate.
