In the matter of Bherawa Textile Industries Private Limited

National Company Law Tribunal7 September 2020

Ratio decidendi

The rule this decision rests on

The Tribunal treats the operational creditor's unpaid invoices, supported by a demand notice that the corporate debtor failed to dispute in its reply, as establishing the claim and a prima facie default in payment; where no dispute exists in the record, the default is established and the application under Section 9 may be admitted. A claim of operational debt is within limitation where the default is continuing, the earliest default falling within the limitation period and the subsequent defaults being part of a continuous failure to pay, so that the application is not time-barred. The Tribunal has jurisdiction over an application under Section 9 where the corporate debtor's registered office is situated within its territorial jurisdiction, and it may admit the application and initiate the corporate insolvency resolution process where the statutory requirements are satisfied.
