The rule this decision rests on

The Adjudicating Authority may order liquidation under Section 33(2) of the Insolvency and Bankruptcy Code, 2016 where the Resolution Professional intimates a decision of the Committee of Creditors, approved by not less than sixty-six percent of the voting share, to liquidate the corporate debtor, and that intimation is made before confirmation of a resolution plan; where the CoC has first rejected the sole resolution plan and then approved liquidation with 95.52% voting share, the statutory condition is satisfied and the liquidation order follows.
