In the matter of Bharati Defence & Infrastructure Ltd.
- CitationI.A. 4041 & 4042 of 2023 in C.P.(IB) No. 292-MB-2017
Ratio decidendi
The rule this decision rests on
Creditors of a corporate debtor who do not file their claims within the time fixed in the liquidation process cannot demand payment, in the liquidation, of dues relating to the period up to the date of the sale certificate; to the extent such claims are admitted by the liquidator, they are payable from the liquidation estate in accordance with the Code. Tax or charges relating to the period after the issuance of the sale certificate are recoverable from the auction purchaser, not from the liquidation estate, and the auction purchaser is not liable for tax or charges relating to the period up to the issuance of the sale certificate, which are to be dealt with under the Code. Once the auction purchaser pays tax or charges for the post-sale-certificate period, the concerned authorities may not take action against the auction purchaser or its property in respect of those dues.
