National Company Law Tribunal21 June 2023

Ratio decidendi

The rule this decision rests on

An application by the Interim Resolution Professional under Section 12A of the Insolvency and Bankruptcy Code, 2016, read with Regulation 30A of the CIRP Regulations, may be allowed to withdraw a Section 7 petition admitted against a corporate debtor where no public announcement under Regulation 6 has yet been issued and no Committee of Creditors has yet been constituted, the conditions for withdrawal under Regulation 30A(1)(a) being satisfied. Where the financial creditors have filed the withdrawal application in Form FA and the costs of the insolvency resolution process have been borne by the financial creditors and the corporate debtor has paid the requisite CIRP cost and IRP fees, the requirements of Regulation 30A(2) are to be treated as complied with. Upon allowing such withdrawal, the Adjudicating Authority may release the corporate debtor from the rigours of the CIRP, direct the IRP to hand over the assets and affairs of the corporate debtor to the suspended board of directors, discharge the IRP, and terminate the moratorium with effect from the date of the order, closing the petition.
