Ratio decidendi

The rule this decision rests on

The Adjudicating Authority may permit withdrawal of a petition admitted under Section 7 of the Insolvency and Bankruptcy Code, 2016, before the constitution of the Committee of Creditors, where the withdrawal is sought by the Interim Resolution Professional under Section 12A of the Code read with Regulation 30A of the CIRP Regulations, and the conditions for withdrawal under those provisions and Rule 11 of the NCLT Rules, 2016 are satisfied, namely that no claims have been received from creditors, the parties have settled the matter amicably, the petitioners have executed and submitted Form FA withdrawing the petition, and the fees and CIRP expenses have been cleared by the petitioners. Upon such withdrawal, the moratorium imposed under the Code ceases to have effect from the date of the order, the Interim Resolution Professional stands discharged, and the management and affairs of the corporate debtor are to be handed back to its suspended Board of Directors.
