In the matter of ADITYAMAN ENTERPRISES PRIVATE LIMITED

National Company Law Tribunal6 March 2025

Ratio decidendi

The rule this decision rests on

The Tribunal's reasoning admits a Section 7 application where the Financial Creditor's record shows a financial debt disbursed to the Corporate Debtor and a default in repayment of that debt, the default being established on the materials placed on record, including the demand notices and the Information Utility record, with the application filed within the limitation period of three years from the date of default; the Corporate Debtor's failure to file any reply and its ex parte proceeding do not displace that finding.
