In the matter of Aditi Health Oils Private Limited
- CitationIA(I.B.C)-87(KB)2024 in C.P. (IB)-1178(KB)2018
Ratio decidendi
The rule this decision rests on
The Tribunal, in dissolving the Corporate Debtor under the Insolvency and Bankruptcy Code, 2016, held that where the assets of the Corporate Debtor have been completely liquidated and the proceeds distributed, the liquidator is required to apply to the Adjudicating Authority for dissolution under Section 54(1), and the Adjudicating Authority, acting under Section 54(2), may order dissolution from the date of its order where no party would be affected by it. Where the liquidation is complete and the Liquidator has been permitted to continue to pursue pending avoidance applications (under Sections 43 and 66) as authorised representative of the Stakeholders' Committee, the Tribunal held that such continuation does not preclude dissolution of the Corporate Debtor, the pending proceedings being pursued in that representative capacity.

Memari, Dist:-Burdwan, West Bengal. The Applicant also alleges that the liquidator sold the entire portion of land that was marked by SG surveyor including the portion of the land that belongs to the Applicant. b. As such the Liquidator should be asked to handover possession of the said plots of land. Under Plot nos. 4633 and 4634, to the Applicant as they do not form the CD’s assets. c. The Liquidator appearing in person submits that the list of property given by way of table I which is in page no. 36 of the reply, does not mention the plots that belong to the Applicant.
