In the matter of Adico Forge Private Limited

National Company Law Tribunal23 June 2023

Ratio decidendi

The rule this decision rests on

Where a corporate debtor, in its reply to a Section 9 petition, admits both the existence of the operational debt and the default in repaying it, and offers no dispute on the record, the Adjudicating Authority has no discretion to refuse admission; the petition must be admitted, and the Corporate Insolvency Resolution Process initiated, once the debt and default are established as admitted.
