Hindustan Motors Ltd vs Na

National Company Law Appellate Tribunal25 April 2017

Ratio decidendi

The rule this decision rests on

Under the amended Section 4(b) of SICA, as substituted by the Insolvency and Bankruptcy Code, 2016, proceedings pending before the BIFR or AAIFR abate on the notified date, and a company whose proceedings have so abated may make a reference to the National Company Law Tribunal under the Insolvency and Bankruptcy Code, 2016 within one hundred and eighty days of the commencement of that Code. A petition seeking clarification of the effect of abatement under Section 4(b) of SICA, where no proceeding has been initiated under the Insolvency and Bankruptcy Code, 2016, is not maintainable before the Tribunal; the proper course is for the company to file under the Insolvency and Bankruptcy Code, 2016 within the prescribed period, and the Tribunal can take cognizance only of such a filing.
