Hema Manoj Shah. Liquidator Of Shivam ... vs Asset Reconstruction Company (India) ...

National Company Law Appellate Tribunal19 September 2019

Ratio decidendi

The rule this decision rests on

Where a liquidator appointed under the Insolvency and Bankruptcy Code, 2016 seeks release for personal reasons and has not given her consent under Section 34, the Adjudicating Authority should consider releasing her and appointing another liquidator, and may draw the replacement from the panel of Interim Resolution Professionals maintained by the Insolvency and Bankruptcy Board of India; the appointment of a liquidator without the consent required by Section 34 is a matter the Adjudicating Authority must reconsider on the liquidator's request. Pending the appointment of a replacement, the existing liquidator continues to act in that capacity.
