Harsh Arya vs State Of U.P.

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

Where co-accused persons in the same case have been granted bail, an accused with no criminal antecedents who has been in custody for a substantial period establishes a prima facie case for bail, and bail shall be granted even without expressing an opinion on the merits of the case. Bail conditions imposed by the court may be cancelled by the trial court if the accused breaches any of those conditions.
