General Motors India Private Limited, , ... vs Assessee

Income Tax Appellate Tribunal15 May 2015

Ratio decidendi

The rule this decision rests on

The stay of a tax demand pending appeal is granted on conditions where the assessee shows a prima facie case and agrees to deposit a part of the disputed demand, the Tribunal weighing the assessee's willingness to pay a sum of the demand against the revenue's position that a larger percentage should be paid. Where the assessee is registered as a sick industrial company and the registration is before the Board for Industrial and Financial Reconstruction, the Tribunal treats the statutory bar on coercive recovery as a matter the assessee may put forward in support of a stay, but the order does not decide whether that bar applies to the demand in question.

He therefore submitted that the addition of Rs. 300 crores was identical to that of earlier years and the issue has been decided in favour of the Assessee. 3. We have heard the rival submissions and perused the material on record. 3 S.P No 47/A/15 (in ITA No. 713/A/2015) . A.Y. 2010-11
