Gangotri Tracon Pvt. Ltd vs Rachna Anchalia
- CitationComp. App. (AT) (Ins) No. 1092 of 2023
Ratio decidendi
The rule this decision rests on
The Tribunal dismissed an appeal against rejection of an application to condone a 216-day delay in filing a claim with the resolution professional, and in doing so it relied on the principle that a commercial entity must act diligently once publication of the CIRP has been made in newspapers, so that delay in filing a claim in such circumstances is not condoned merely on the applicant's assertion that publication was limited to one edition.
