Eka Life Limited vs Amarpal

National Company Law Appellate Tribunal7 April 2025Ashok Bhushan

Ratio decidendi

The rule this decision rests on

A recall application that in substance seeks a review of an earlier order is not maintainable before the Tribunal, because a tribunal has no jurisdiction to review its own judgments; an order passed after hearing the parties can be recalled only on the limited grounds recognised by the law, and mere grounds asserting incorrect findings do not suffice to justify recall.
