Eastern Ranges Flat Owners Welfare ... vs Phadnis Properties Ltd. & Ors

National Company Law Appellate Tribunal14 March 2019

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal will not interfere with an order of liquidation where more than 270 days have elapsed since the insolvency commencement and no other ground is shown to justify setting it aside, so that the claimant's contention that it should have been permitted to submit a resolution plan does not, on its own, warrant interference. During the liquidation process, the liquidator is bound to follow the procedure laid down by the Tribunal in the earlier decisions of S.C. Sekaran v. Amit Gupta and Y. Shivram Prasad v. S. Dhanapal, which the Tribunal adopts by reference, including the requirement that liquidation proceed in accordance with the provisions of Section 230 of the Companies Act, 2013.
