Dr. Mukesh Kesharwani And Another vs State Of U.P. Thru. Prin. Secy. Home Lko. ...

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

Where a compromise is alleged in criminal proceedings, the trial court must verify it by issuing notices requiring the personal presence of all signatories to the compromise, and only after such verification shall the compromise be made part of the record and a verification report prepared. The trial court must also examine whether all parties against whom the charge-sheet was filed are parties to the compromise and report accordingly. A compromise in criminal proceedings cannot be acted upon without such prior verification by the court in the presence of the parties concerned.
