Disposal of representation of Mr Anurag Khandelia in the matter of First Financial Services Ltd

Securities And Exchange Board Of India18 October 2016

Ratio decidendi

The rule this decision rests on

A person who is not himself restrained by an interim order, and whose demat account is frozen only because he is a joint holder with a restrained person, may be permitted relief where the documentary evidence shows that the securities in the account were acquired from his own funds and that he holds the rights and interests in them. In such a case, the restraint against the co-holder does not extend to securities beneficially owned by the non-restrained applicant. Where the balance of convenience favours such an applicant, interim relief may be granted by permitting the transfer of those securities to a demat account held in his sole name. That relief is subject to the supervision of the stock exchanges and depositories and is without prejudice to the findings of the pending investigation.
