Ratio decidendi
The rule this decision rests on
Where a party seeks to rely on fresh documents that go to the root of the matter, and the tribunal finds that those documents were not produced before the Assessing Officer or the first appellate authority for reasons the party explains, the tribunal may set the matter aside and remand it to the Assessing Officer to be decided afresh in accordance with law, after affording the assessee due and reasonable opportunity of being heard and considering the new documents.
