Deepu Goswami vs State Of U.P.
- Neutral2026:AHC:104570
Ratio decidendi
The rule this decision rests on
Upon consideration of the totality of facts, nature and evidence in a case arising under the Narcotic Drugs and Psychotropic Substances Act, read with Section 37 of that Act, a court may grant bail during the pendency of trial where it finds the case to be a fit one for bail, without thereby expressing any opinion on the merits which remain open to independent determination by the trial court. Breach of conditions imposed on bail granted under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 constitutes a ground for cancellation of the bail.
