Cupid Ltd vs Sebi

Securities Appellate Tribunal14 February 2023Tarun Agarwala

Ratio decidendi

The rule this decision rests on

The appeal is disposed of by reference to the Tribunal's earlier decision in Shekhawati Poly-Yarn Ltd. & Ors. vs. NSE and Ors. (Appeal No. 432 of 2021, decided 18 July 2022). Where the reasons for the present decision are those stated in that earlier decision, the controversy in this appeal is governed by the principles laid down there, and the impugned order dated 13 April 2021 falls to be quashed on the same reasoning. The principles of Shekhawati Poly-Yarn are not themselves set out in this text, so the ratio of this order is only that the earlier decision governs and the impugned order is quashed on its basis.
