Commissioner Of Customs And Central ... vs M/S. Classic Traders

Customs Excise and Service Tax Appellate Tribunal12 August 2015

Ratio decidendi

The rule this decision rests on

The Tribunal dismisses a Revenue appeal where the amount involved is less than Rs. 5,00,000 without examining the merits, applying the Government's litigation policy as reflected in Board instruction F.No. 390/Misc./163/2010-JC dated 17/08/2011, read with the High Court decisions cited (Gujarat and Karnataka), which the Tribunal treats as supporting that policy.
