Commissioner Of Central Excise vs Jcb India Ltd

Customs Excise and Service Tax Appellate Tribunal18 May 2015

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal has no jurisdiction under the proviso to Section 35B(1)(b) of the Central Excise Act, 1944 to entertain an appeal against an order of the Commissioner (Appeals) under Section 35A that relates to rebate of duty of excise on goods exported outside India, and an appeal filed by the Revenue against such an order is therefore not maintainable and must be dismissed, without prejudice to the Revenue's right to approach the appropriate forum.
