Commissioner, Central Excise & Service ... vs M/S Vartellus Speciality Materials ...

Customs Excise and Service Tax Appellate Tribunal17 June 2015

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal has no jurisdiction to entertain an appeal against an order of the Commissioner (Appeals) that relates to rebate of excise duty on goods exported, by reason of the first proviso to Section 35B(1) of the Central Excise Act; such an appeal is therefore not maintainable and is dismissed, along with the cross-objection and the CO application that depend on it.

The Revenue filed this appeal against the order of Commissioner (Appeals), whereby the Commissioner (Appeals) remanded the matter to the Adjudicating authority for verification and quantification of the rebate claim. The learned Authorised Representative for the Revenue submits that the Commissioner (Appeals) has no power to remand the matter. On the other side, the learned Advocate submits that the appeal filed by the Revenue against the order of Commissioner (Appeals) in respect of rebate claim, is not maintainable. As per the First Proviso to Section 35B(1), no appeal shall lie to the Appellate Tribunal and the Appellate Tribunal shall not have jurisdiction to decide any appeal in respect of any order passed by the Commissioner (Appeals) relates to rebate of duty of Excise on goods exported to various countries. Both the sides submit that the appeal relates to rebate claim.
