Col A Khanna Sm Retd vs Directors Appointed By Dgcoa Delhi ...

National Company Law Appellate Tribunal10 August 2023Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The word "may" in paragraph 5 of the order dated 02.06.2022 is directory and not mandatory, so a party's failure to file the reports directed to be placed before the NCLT, where the respondent has filed them before the NCLT and sought leave to file in a sealed cover, does not without more amount to a violation of that order warranting initiation of contempt proceedings.
