Chowringhee Holdings (P) Limited, ... vs Assessee

Income Tax Appellate Tribunal26 February 2015

Ratio decidendi

The rule this decision rests on

Where a sundry creditor balance is an opening balance carried forward from an earlier year, and no fresh transaction with that creditor occurred in the relevant assessment year, the Assessing Officer cannot make a disallowance of that balance as a bogus liability in the relevant assessment year. Where the Assessing Officer has not verified the underlying transactions between the assessee and the creditor so as to establish that the assessee has claimed a bogus sundry creditor, an addition based on treating the balance as bogus cannot be sustained. Where a claimed deduction or payment is disallowed for want of production of a receipt, and the assessee has not been afforded an adequate opportunity to produce that receipt, the matter is to be restored to the Assessing Officer for re-adjudication after granting such opportunity.
