Chittaranjan Locomotive Works vs M/S Stesalit Ltd. & Ors
- CitationCOMPANY APPEAL (AT)(INSOLVENCY) NO.627 OF 2021
Ratio decidendi
The rule this decision rests on
The appellant's knowledge of the approved resolution plan, shown by letters issued to it in 2018, fixes the point from which limitation runs for an appeal against the NCLT order approving that plan; the appellant's failure to file within the limitation period, unexplained by cogent reasons, and a delay of more than three years, mean that an application for condonation of delay must be refused and the appeal is therefore barred by limitation.
